Your legal duty of care
why your business needs a licensed waste carrier
Every UK business has a legal Duty of Care for its waste under Section 34 of the Environmental Protection Act 1990. That means:
• Your commercial waste must be stored securely on your premises
• It must only be collected by a licensed waste carrier registered with the Environment Agency
• Every collection must be documented with a Waste Transfer Note
Using an unlicensed man-and-van operator or putting trade waste in domestic bins will lead to fines of up to £5,000 in a magistrates’ court, or unlimited fines for serious offences. If your waste is fly-tipped by an unlicensed carrier, YOUR business can be prosecuted, even though someone else dumped it.
